General Terms and Conditions

1. Parties

These General Terms and Conditions ("Terms") govern your use of the RapidResident platform ("Platform", "Service") operated by RapidResident ("we", "us", "our"), registered with the Dutch Chamber of Commerce (KVK: 67252109), VAT number NL002268813B32.

By creating an account or using the Platform, you ("User", "you", "your") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Service description

RapidResident is a digital medical education platform designed for medical professionals and students, with a focus on anaesthesiology and EDAIC exam preparation. The Platform provides:

• An EDAIC Part I question bank with multiple true/false (MTF) practice questions
• Practice modes including exam mode, practice mode, random practice, all-subjects mode, and mistake review
• Progress tracking and performance analytics
• Flashcards and medication references
• E-learning modules (where available)

The Platform is provided on an "as-is" basis. We strive for high availability but do not guarantee uninterrupted or error-free access. Scheduled maintenance will be announced where possible.

3. Account registration and responsibilities

To access the Platform, you must create an account with a valid email address and password. You are responsible for:

• Providing accurate and complete registration information
• Keeping your login credentials confidential and secure
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

Each account is for personal use only. You may not share your account credentials with others or allow multiple individuals to use the same account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription terms

The Platform offers a Free tier with limited access and a Plus subscription with full access to all content and features.

• Plus subscriptions are billed monthly on a recurring basis from the date of purchase.
• Auto-renewal: Your subscription automatically renews each month until cancelled. You will be charged on the same date each month.
• Cancellation: You may cancel your subscription at any time from your dashboard. Access continues until the end of the current billing period. No partial refunds are given for unused time.
• Price changes: We may change subscription pricing. Existing subscribers retain their price at the time of subscription (grandfather clause). Price changes apply only to new subscriptions and renewals after the change takes effect.

5. Payment terms

All payments are processed securely through Mollie, our payment service provider. We accept iDEAL, credit card, and SEPA Direct Debit.

• All prices are in euros (EUR) and include 21% Dutch VAT (BTW) unless stated otherwise.
• Access to Plus content is granted immediately upon successful payment.
• If a recurring payment fails, access to Plus features is suspended until payment is resolved. Your account and study progress are preserved.
• Invoices are generated automatically and available for download in your dashboard.

6. Right of withdrawal

In accordance with Article 16(m) of the EU Consumer Rights Directive (Directive 2011/83/EU), you expressly agree at the time of purchase that:

• The digital service is made available to you immediately after payment;
• You waive your 14-day right of withdrawal by requesting immediate access;
• No refund is available once access to the digital content has been granted.

7. Intellectual property

All content on the Platform — including but not limited to questions, explanations, flashcards, e-learning materials, illustrations, software, trademarks, and designs — is the property of RapidResident or its content partners and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Platform without our prior written permission. Scraping, automated data extraction, or reverse-engineering of the Platform is strictly prohibited.

8. Medical disclaimer

The content on the Platform is intended solely for educational purposes and is designed to support exam preparation and learning. It is not intended to serve as medical advice, clinical guidance, or a substitute for professional medical judgment.

Always rely on current clinical guidelines, local protocols, and your own professional judgment when making clinical decisions. RapidResident is not responsible for any clinical decisions made based on content from the Platform.

9. Limitation of liability

To the maximum extent permitted by applicable law, RapidResident shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or study progress
• Incorrect or incomplete content
• Platform downtime or unavailability
• Exam results or professional outcomes

Our total liability for any claim arising from or related to the Platform is limited to the amount paid by you to RapidResident in the three (3) months immediately preceding the event giving rise to the claim.

While we strive for accuracy, we do not warrant that all content is free from errors. If you encounter incorrect content, please report it using the "Report error" feature within the Platform.

10. Privacy

We are committed to protecting your personal data. Our collection, use, and processing of personal data is governed by our Privacy Policy, which forms part of these Terms.

11. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands.

12. Changes to these Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated to registered users by email with at least 30 days' notice before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
